You are about to make a purchase on the Silver Linings Arts website. Before doing so, we strongly recommend that you read the Terms and Conditions of Sale set out below.
These terms of sale apply to all products sold via the website https://silverliningsarts.com/.
Article 1 – Purpose
These Terms and Conditions of Sale govern the contractual relationship between:
- On the one hand, Silver Linings Arts, whose registered office is located at 37, Rue d’Amsterdam – 75008 PARIS;
- And on the other hand, any individual or legal entity wishing to make a purchase on the Silver Linings Arts online sales website, hereinafter referred to as the “customer” or “buyer.”
The customer acknowledges having read these Terms and Conditions of Sale prior to placing an order and expressly declares that they accept them without reservation. These Terms and Conditions of Sale shall prevail over any other terms appearing in any other document, unless otherwise agreed in advance, expressly, and in writing.
These Terms and Conditions of Sale may be modified at any time by Silver Linings Arts without prior notice. However, the conditions applicable to the buyer shall be those in force on the website at the time the order is validated.
Article 2 – Products and Services
Silver Linings Arts (“SLA”) offers paid participation in curated exhibitions (physical and/or online) and a separate online showcase subscription, as described on the website.
Article 2.1 – Definition of Participation Right
A “Participation Right” is the right to submit artwork for review by SLA’s curatorial team for possible inclusion in a specified exhibition or showcase. Purchase of a Participation Right grants only the right to be considered. It does not constitute, and shall never be construed as constituting, any guarantee of selection, inclusion, publication, or display. All selection decisions are made at SLA’s sole discretion and are final.
This applies equally to all tiers, including the €20 online showcase subscription: payment secures a right to apply for inclusion, not a guaranteed listing. Every effort has been made to present the characteristics of the services offered as accurately as possible and to ensure the accuracy of the information displayed on the website. Photographs are provided for illustrative purposes only.
Article 3 – Availability
These services are offered as long as they are visible on the website, subject to available curatorial capacity. Information on the website is provided for indicative purposes only.
In the event that a service becomes unavailable after an application has been submitted, the applicant will be informed by phone or email as soon as the relevant information is known.
Article 4 – Application, Order Process, and Artist Space Access
An application is submitted directly via the online application form on the Silver Linings Arts website; no account creation is required.
The information entered by the applicant (name, contact details, email address, artwork information, etc.) is binding on them. Silver Linings Arts cannot be held responsible for inaccuracies in the information provided, nor for any resulting inability to process the application, contact the applicant, or communicate a curatorial decision.
An application is validated once the applicant completes payment on the application form. Payment validation constitutes the applicant’s formal request for curatorial review and does not, by itself, constitute a complete application unless the requirements of Article 4.1 are also met.
Following payment, Silver Linings Arts will send the applicant an email confirming that their application has been received and is under curatorial review. This confirmation acknowledges receipt only; it does not confirm selection, inclusion, or acceptance into any exhibition or showcase.
If an applicant is selected by the curatorial team, Silver Linings Arts will send that applicant, at their submitted email address, individual login credentials (artist username and passcode) granting access to their dedicated Artist Space on the website.
All data provided and the recorded payment confirmation constitute proof of the transaction and are deemed equivalent to the applicant’s signature and acceptance of the operations carried out.
Silver Linings Arts shall not be held liable for the consequences of events beyond its control, including cases of force majeure, that may delay or prevent the submission or processing of an application. Silver Linings Arts reserves the right to refuse or cancel any application for any reason, including but not limited to: incomplete application materials under Article 4.1, suspected fraud or misrepresentation, non-payment, or an unresolved dispute relating to a previous order by the same applicant.
Article 4.1 – Application Completeness
To be eligible for curatorial review, an application must include, in addition to payment:
(a) digital image files of the artwork(s) submitted;
(b) an artist statement or CV; and
(c) at least one verifiable means of confirming the applicant’s identity and ongoing art practice (e.g., a personal website, portfolio, or active social media profile). SLA reserves the right, at its sole discretion, to decline to process any application that does not meet these requirements. Payment made in connection with an incomplete, unverifiable, or non-compliant application is not refundable, in accordance with Article 7.
Article 4.2 – Sale Condition and NFS
SLA is a commercial gallery, not a nonprofit, association, or educational institution. Accordingly, artwork submitted under any paid exhibition tier (physical or online open call) must be offered for sale. “Not-For-Sale” (NFS) status is not available under these tiers. An applicant who does not wish to offer work for sale may only apply under SLA’s designated non-commercial online showcase tier (currently €20), which is for display purposes only and, per Article 2.1, likewise does not guarantee selection.
Article 5 – Payment
Payment for purchases made on the Silver Linings Arts website is made at the time of ordering, using the buyer’s chosen method:
- By bank card (CB, VISA, and MASTERCARD networks).
In all cases, the applicant’s order will be considered accepted after payment has been confirmed and validated by Silver Linings Arts.
Article 6 – Right of Withdrawal (Waiver)
By completing payment, the customer expressly requests that SLA begin performance of the service — namely, curatorial review of the submitted application — immediately upon receipt.
In accordance with Article L221-28 of the French Consumer Code, the statutory right of withdrawal does not apply to services related to leisure activities where the contract specifies a particular date or period of performance, which applies to Participation Rights tied to a specified exhibition or showcase period. Accordingly, all payments made for Participation Rights are final and non-refundable from the moment payment is confirmed, regardless of subsequent selection outcome, application completeness, or any change of intent by the customer.
Article 7 – Refusal, Fraud, and Payment Disputes
SLA reserves the right to refuse, suspend, or terminate, without refund, any application that:
(a) is incomplete under Article 4.1;
(b) contains information reasonably believed to be false, fraudulent, or misleading; or
(c) lacks verifiable proof of an authentic, ongoing art practice by the applicant. In the event of a payment dispute, chargeback, or challenge initiated with a card issuer or payment processor, SLA reserves the right to submit these Terms and Conditions, the order confirmation, and any related correspondence as evidence to the payment processor, and to seek recovery from the customer of any resulting fees, penalties, or losses incurred by SLA.
Article 8 – Intellectual Property
Content presented on this website that is subject to third-party intellectual property rights may not be reused without the prior consent of the rights holders. If the customer wishes to reproduce or reuse videos, photographs, illustrations, logos, etc. appearing on the website, they must contact the following address to learn the conditions applicable to reuse of the relevant content: contact form.
Unless otherwise stated, company names, logos, and trademarks mentioned on this website are the property of Silver Linings Arts or its partners/clients who have authorized their reproduction for promotional purposes only. Any total or partial reproduction made from elements of the website without the express authorization of Silver Linings Arts or its partners/clients is prohibited, within the meaning of Article L713-2 of the French Intellectual Property Code.
